1. ROLE OF CAPTURE KENYA EXPEDITIONS
    The role of Capture Kenya Expeditions is to customize tours and itineraries to fit the requirements of our customers. In doing so, Capture Kenya Expeditions may use other suppliers for the provision of selected services. However, Capture Kenya Expeditions accepts responsibility for the proper performance of your contract with us, subject to the following booking conditions.
  2. RESERVATIONS & BOOKINGS
    Bookings shall be made and confirmed in writing by E-mail or any other acceptable form with the correct names, nationalities and date of birth of all travelers – as per their passport. If a tour or hotel is, fully booked Capture Kenya Expeditions will offer you an alternative property of a similar standard and location. Bookings shall be considered confirmed only when the booking is accompanied by a deposit of 35% of the tour price, whose receipt we will acknowledge. The remaining 65% must be paid no later than 45 days from the trip starting date.
    On accommodations, all our rates are based on per person sharing a twin room/tent per night. All Nairobi Hotels unless stated otherwise are booked on Bed and Breakfast. All Beach resort are based on Half Board while all Lodges and Camp in Parks are based on full Board. Single rooms are available at an additional cost but cannot be guaranteed and clients will have to pay a single room supplement.
  3. CANCELLATIONS & REFUND
    Any cancellation of a reservation must be made in writing and delivered either by hand, post, fax or electronic mail, and shall only be effective upon its receipt and acknowledgment. The following cancellation fees will be made for cancellations: More than 45 days prior to trip commencement 35% of tour price, 40 days to 30 days prior to trip commencement 50% of tour price, 29 days to 15 days prior to trip 75% of the tour price, From 14 days and below including no show, 100% of the total tour price. The payment of bank fees for bank transfers are the responsibility of the customer and are strictly non-refundable.
    The trip may be cancelled with no penalty charge should war, a life-threatening epidemic, or any other natural catastrophe or similar event occur within 14 days prior to departure. This will however be on the condition that your government advises against travelling to the specific area, and that the situation in question has arisen after the booking of the tour was made.
    In the case of death or serious illness, special cancellation terms can be negotiated if Capture Kenya Expeditions is presented with an officially approved death/sickness certificate.
  4. AMENDMENTS / CHANGES
    Prior to confirmation and before 40 days to tour commencement and subject to tour component availability, a client can change or amend the tour. Any other amendment by the client of a once confirmed itinerary will be charged by a reasonable amount depending on the applicable cancellation terms with the service provider as well as our terms and conditions of cancellation.                                                                                                     Capture Kenya Expeditions reserves the right to alter arrangements or cancel the operation of a scheduled tour should conditions necessitate.
    Most changes will be minor, but if Capture Kenya Expeditions has to do significant changes, you will be notified at the earliest possible opportunity. In such cases, you will have the opportunity to accept the changes or to receive a full refund.
    Some service prices, such as (but not limited to) park fees, government levies and airport taxes are not in the control of Capture Kenya Expeditions. In the event of these prices being changed at any date Capture Kenya Expeditions will charge a supplementary cost the client.
  5. RATES / PRICES
    All prices are based on costs at the time of publication. The tour and safari rates includes all expenses in respect of full board (3 meals a day) while on safari, whether in hotels, lodges, tented camps, mobile tented camps, or bush camps as specified in your itinerary. In most instances unless otherwise stated, all city/town hotels will be on bed and breakfast basis while beach hotels will be on a half board basis. All park and game reserves entrance fees, including conservation fees, camping fee, concession fee among others as quoted. Game drives are in our safari vehicles with window seat guaranteed. Transportation will be in either 4×4 safari jeep/land cruiser or a 4×4 safari van or flight, as specified in your itinerary and by experienced in-country safari guides. Airport transfers may be by use of a coach or a small vehicle depending on the number of clients being transferred. There are extra supplements charges that are included in the final invoice. They include Easter, Christmas and new Year Supplements. The Christmas and Easter are always included in all customized safari quotes.
  1. PAYMENT
    One can deposit/wire transfer directly to our account and pay the applicable deposit/transfer charges within 7 days of Capture Kenya Expedition confirmation of the booking. Payment by foreign currency will be subject to exchange rate in time of booking. Kindly let us know your preferred mode of payment.
    For groups, a 20% of the total booking value within 7 days of Capture Kenya Expedition’s confirmation of the booking. The remaining 80% should be paid not later than 45 days from the trip starting date. 60 days prior to arrival, preliminary rooming list will be requested and 35 days prior to arrival, we will confirm the rooming list as final.
  1. RISK
    Capture Kenya Expedition and its owner, director, management staff and employees shall not be held responsible for any injury or death to persons on tour, or for loss or damage to personal property. The company draws your attention to the fact that there are certain inherent health as well a physical risks present when on Safari. The company will advise on relevant risk involved and advice you to take precaution measure while on safari.
    Capture Kenya Expedition advises you to take relevant travel and person insurance. However, the company can assist with local insurance arrangement and all your tours are covered by the Flying doctors for ease of evacuation in case of any health incidence or accident in the course of the tour.
    The company shall not be deemed to be in breach of these items and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.
    If the company is affected by force majeure it shall be entitled to, and may at its sole and absolute discretion, vary or cancel any reservations or cancel any reservation or arrangement in relation to the safari/tour. Payment of any refund by the company to you as result of the non-performance of any company shall use its reasonable endeavors to reimburse you where possible. However, the company shall be entitled to deduct from any refund recoverable to the reasonable actual and potential costs to the company of the force majeure.
  1. TERMS & CONDITIONS
    These are the terms and conditions governing the relationship between Capture Kenya Expedition and you, to the total exclusion of any other terms and conditions. No alterations to the terms and condition may be made by any of the company’s employees, authorized representative or agents, unless in writing by an authorized officer of the company. All decisions and matters subject to the company’s discretion shall be by authorized officer of the company. The Company reserves the right to employ sub-contractors for all or part of the services.
  1. CONSENT
    The payment of the deposit or any other partial payment for a reservation constitutes consent to all provisions of the Terms and Conditions. The Terms under which you agree to make the reservation cannot be changed or amended unless this is done in writing and signed by the company management.
  1. COMPLAINTS
    Should a problem occur, please advise both Capture Kenya Expedition and the service supplier in question immediately, as most problems can be solved on the spot. Should you remain dissatisfied, please write to us setting out the complaint in detail within 28 days of the end of our services under the contract. Capture Kenya Expedition cannot accept responsibility for any complaints which are not notified entirely in accordance with this clause. Should any legal dispute arise it must be settled in Nairobi according to and depending on which Capture Kenya Expedition booking office(s) was/were used for the rendered services
